Local Attorney Offers Immigration Advice Following Trump’s Election

President-elect Donald Trump has vowed to reverse DACA, to deport millions of undocumented immigrants and to build a wall between the United States in Mexico. The office has been flooded with calls, consultations, and emails from anxious clients from both sides of the border.
A detainee must have a hearing at Immigration Court before a removal or deportation takes place. Nowadays I have clients whose final hearings are set to take place in 2021; Immigration courts and the Department of Homeland Security do not have enough resources and staff. If President-elect Trump fulfills his promise of deporting millions of immigrants, it will create an unprecedented problem in the already understaffed immigration courts.
I have clients that don’t want to renew DACA, they fear Trump will reverse that executive action before the renewal application is adjudicated; I believe that is a big mistake.
Donald Trump is softening the rhetoric. He will soon realize that implementing what he promised during his campaign is impossible. Perhaps he knew that all along.
I urge the community not to listen to alarmist news and social media posts. Deporting millions of immigrants goes in direct contravention of Trump’s other promise, to lower taxes. However, if you are arrested or detained by the Department of Homeland Security, my advice remains the same:
- Don’t panic;
- It is wise not to discuss the case with the authorities, there is no such thing as a “friendly chat” to sort things out. Anything you say can later be used against you; and
- Hire a lawyer.
