Supreme Court Sends Affirmative Action Case Back

supreme-court-justicesThe Supreme Court has sent a Texas case on race-based college admissions back  to a lower court for another look, keeping alive the plaintiff’s case — and the  chance to repeal Affirmative Action.

The court’s 7-1 decision Monday leaves unsettled many of the basic questions  about the continued use of race as a factor in college admissions.

Justice Anthony Kennedy, writing for the court, says a federal appeals court  needs to subject the University of Texas admission plan to the highest level of  judicial scrutiny.

The case was brought up by a white woman denied admission to the University  of Texas who seeks to overturn the school’s consideration of race among many  factors in filling the last quarter of its freshman classes. 

A broad ruling would have ended the use of race in college admissions  nationwide.
