Pistorius Verdict: Culpable Homicide

Not murder, but culpable homicide was the verdict in the trial of South African track star Oscar Pistorius. 

Pistorius fatally shot his girlfriend Reeva Steenkamp on Valentine’s Day 2013.

Judge Thokozile Masipa cleared the athlete of murder.

Culpable homicide is defined as “unlawful or negligent killing,” the offence of culpable homicide does not require intent or premeditation. 

“The state clearly has not proved beyond reasonable doubt that the accused is guilty of premeditated murder,” Judge Mazipa read in court during the verdict.

Pistorius could still face jail time; culpable homicide carries a maximum sentence of 15 years in jail to a suspended sentence.   

The following is the recap of the four counts against Pistorius:

(1) Not Guilty of murdering Oscar Pistorius, Guilty of culpable homicide

(2) Not Guilty of firearms charge relating to sunroof incident

(3) Guilty of negligence in regards to firearms charge relating to Tashas restaurant

(4) Not Guilty of firearms charge relating to possession of illegal ammunition

All along the athlete’s defense was that he thought there was an intruder at the house, therefore firing the gun.

After the verdict the Judge did not impose a sentence.  

Pistorius will be freed on bail and will return for sentencing on October 13.

Pistorius became a hero to many in South Africa and was a sensation during the 2012 Olympics as he became the first double leg amputee to compete in the Olympics, he participated in the 400 meter race and the 4 X 400 meters relay.
